Can a child support order be modified if the absent parent is on Social Security disability?

My ex-husband is currently on Social Security disability as well as VA benefits. He only pays $200/month for 2 teenage boys. He makes nearly $5,000.00/month from Social Security and Veteran's benefits and he refuses to help in any way other than the $200.00 from Social Security.Can a child support order be modified if the absent parent is on Social Security disability?
Most states will allow either parent refile for child support. Meaning you can have the state recalculate the child support. You contact the child enforcement agency who is collecting ask them to send you the papers to recalculate your support.


You fill out the forms and send them back in, they inturn send the same stuff to the other parent to fill out. Remeber when you fill the papers out put all expenses, including your co payment for any medical. If you have a child that take regular medication you can calculate your month expenses for that as well.


After that is complete the state will recalculate and determine the proper amount owed.


The monies will not go back, they will just start from the time you file the papers.


Each state is diffrent, Oregon allows this to happen every two years. Best part, it is free. They do not charge to do this through the agency.

Social security will usually supply the equivalent of the SS benefit for all children. Apply for that directly to the SS.

Yes, modify the support order. You should get the % of the state law requires. In Texas we use Fathers for Rights or Legal Aid.( cheap or free help) The state you live in ,you can go to the college campuses and buy law books. You can take him to court and fight it yourself. Sorry , you are getting rip. The state should evalate his income for you, for free. GOD BLESS
