Can I move with my child without the other parent's permission?

I have a son and was wondering if I can just leave with him without the permission from the other parent? And if I do can they file kidnapping charges or anything? We have never been married and we do not have any legal contracts or anything in place as far as custody is concerned. Basically we have a son together, nothing more nothing less.Can I move with my child without the other parent's permission?

You cannot move out of the state, but I would suggest that you speak to a lawyer. Most lawyers will give you a free consultation, that way you can find out for sure what laws would be involved.





With the amount of missing children over the last few years, I would suggest that you go this route, because kidnapping charges might be able to be filed and that could hinder any future chances of custody for you.

WELL, as much as I hate this question I feel compelled to answer it. If there is no court order pertaining to custody of the child than you both have equal custody. You cannot be arrested for kidnapping. BUT!! I want you to think of the harm that this action will have on the child. I have worked for may years in the family services, CPS, fields and know for a fact that the damage can last a lifetime! How old is the child? What are the Mother's circumstances? I bet there is another way you can go. Please respond to my email through Yahoo answers and I will be very glad to help you find other, better ways of handling this situation. If you feel so compelled to run off with your son, there has to be a reason and maybe that reason can help you now. Let me know...JOSA
