Can the parent with NO CUSTODY of the child file statutory rape charges agaginst somebody?

I was reallyy wondering this. I've tried lookin it up, but i get nothing.Can the parent with NO CUSTODY of the child file statutory rape charges agaginst somebody?

1st, parent does NOT file charges, the DA does. 2nd, ANYONE can tell the police or DA about such an allegation, and the DA decides whether there is enough evidence to prosecute it. It's called 'prosecutorial discretion.' Have you EVER noticed the criminal complaint says ';STATE V. SO%26amp;SO';?? that means the 'state' files charges
I'm no lawyer, but I think anybody can report a crime.

yes...unless the parent has been stripped of or relinquished all parental rights, he/she is STILL a parent with all the rights that implies.





Anyone can report a crime...you don't need ';standing';
yes you would be able to file it but you should go to the police so they can find out what they need and talk to you so they know how you know so they can get charges put against the other person. But you have to do it before its to late depending on the age of a child. Cuz they need more physical proof from a child to young to talk about it and then if they are old enough to talk about they need to know things before the steps fade away from their minds

NOBODY can file criminal charges except your local DA's office. (Or the US Attorney's office if it's a Federal crime.)





ANYBODY, however, can file a complaint with the police. They forward the complaint to the DA, who chooses whether or not to file charges. The person who files the complaint does not have to be a parent or guardian. Anyone who has reason to believe a crime has been committed can report it to the police.

Since when does custody mean anything for reporting a crime? I suspect there is more to this than your telling.

if your child is under the age of consent for your state go to the cops and report the satuatory rape. if you have a special victims unit(those cops do nothing but sex crimes) go see them and tell them the situation. but they still need your child there to make a statement.
