Can a physician block the return to play and have it legally enforced? Can a parent legally override a team physician's decision to not allow a child to participate in sports?
As a parent you have the right to let the child play with an injury. That places your child at risk if there really is an injury. If there really is an injury that can get worse, why let the child play. The doctor can give his recommendation and document that he has told you not to allow the child to play. If he allowed him to play before the child is ready then the doctor is liable for saying the child can play when infact it was dangerous to play him. As a doctor, parent and youth soccer coach, I would not play the child if there is an injury that will affect the childs health or play. No matter how much I love the sport and want my kids to win, it is not worth risking my childs health. Think of it this way, sit out a few games or sit out the season if the injury gets worse. Can a parent legally override a team physician's decision to not allow a child to participate in sports?
If the doctor thinks there is a reason for your child not to play sports just get another opinion. If doctor#2 finds the same thing, then don't let the child play.
If you're saying you WANT the kid to play and the team doc says no, then NO, you can't.
All a physician does is offer his professional opinion as to whether a person can play or not. There is no ';legality'; here. The cops aren't going to break up a game if your kid plays, but it's the decision of the team/captain/school/etc to enforce any rule of whether a player needs medical clearance to play, which is for their own protection against lawsuits in case something bad happens. Common sense, right?
If you disagree with the first doc, seek a second opinion. If the second doc agrees with the first, let it go. Don't risk your child's health.
This is a tricky question. If the physician has a medical reason for the child not to play, then the school is obligated to adhere to that decision regardless of the parent's feelings about it. If a school ignores a physician's assessment, then they are liable if injury happens to the kid, not the parent per se.
The parent is only being stupid, and they can override a physician's order, but unless the MD can report the override as child abuse or endangerment, the parent is free to act as they will.
I'm sure, why would you want to do that? Get a 2nd opinion.
You should have said that to begin with. I doubt there is much you can do, sorry
A team physician's medical evaluation of a person's physical ability to engage in sports is rendered as advice to the coaches and parents. The final decision to permit the person to engage in sports and follow the physician's recommendation lies with the coach, keeping in mind the civil ramifications if the person is injured and assuming that the parents would allow the child to play. The only legalities involved are those of a civil nature.
Yes you can over ride it.........
But the question would be..Why would you want to?
If you don't trust your Dr's opinion then get a second opinion
Can the Dr have it legally inforced? I would think it would have to be a pretty extrememe case of the Dr not trusting you to do what is in the best interest of your child
