Does custody of the children go to the parent with the slickest lawyer, or the best parent for the job in a cu

custody hearing?


Does anyone have a link to provide stats on which parent they usually end up with after divorce?


Of course, I would guess they go to the mother usually, but provide a link if you can.

Mothers get custody if they want it. There are exceptions but they are uncommon.





Even a slick lawyer cannot overcome the sexual discrimination that is rampant in the civil and criminal court system in the US. Unless a man has upwards of $50,000 that is unneeded and available to spend on it (and will probably still lose), he will only get custody if the mother decides to let him have it or she is a drug addict with a felony warrant out for her arrest and a history of child abuse and neglect.





Joint custody is nothing more that sole custody with the stipulation that the ';custodial'; parent will notify the non-custodial of important matters before she does whatever she wants in difference to his opinion. In other words, joint or joint-legal custody is worthless. Joint legal AND physical custody is a different matter but more rarely used.





Even with joint physical and legal custody, it is customary for the higher earning parent (virtually always the father) to pay child support to the lower earning parent (virtually always the mother).

in most states the woman doesn't need a slick lawyer. Unless she's a total mess. Drunk, drug addict, etc.

but wealthier people divorce at lower rates, and tend to marry within their financial class. the real custody wars occur within the middle class. and for all their bit*hin' men rarely want custody. they want visitation. most never contest custody.
Actually the childrenare usually awarded to the mother, absent a finding of unfitness. The courts usually do this because they determine the mother is usually the primary parent. That means the majority of the child care duties have been done by her throughout the childrens lives.
- Physical custody usually goes to the parent who had assumed the role of primary caregiver all along.

It hasn't always been that way. In fact considering the big picture only in the last 50-75 years was it even given much thought.
I like your question and I hope you receive many logical replies, because grandparents rights are being pushed aside also. When trying to present a case for the children's safety, the case had not been considered. instead the parent received protection simply for a political front which the newspapers loved to print. Money bought the story and families were torn to shreds. was this a back lashing from another party? possibly but who will come forward with great courage to say '; This is enough!';
